  20.    SEC. 110101. SHORT TITLE.
  21.    
  22.    
  23.    
  24.    This subtitle may be cited as the "Public Safety and
  25.    Firearms Use Protection Act".
  26.    
  27.    
  28.    
  29.    SEC. 110102. RESTRICTION ON MANUFACTURE, TRANSFER, AND POSSESSION OF
  30.    CERTAIN SEMIAUTOMATIC ASSAULT WEAPONS.
  31.    
  32.    
  33.    
  34.    (a) Restriction .-Section 922 of title 18, United States Code, is
  35.    amended by adding at the end the following new subsection:
  36.    
  37.    
  38.    
  39.    "(v)(1) It shall be unlawful for a person to manufacture, transfer, or
  40.    possess a semiautomatic assault weapon.
  41.    
  42.    
  43.    
  44.    "(2) Paragraph (1) shall not apply to the possession or transfer of
  45.    any semiautomatic assault weapon otherwise lawfully possessed under
  46.    Federal law on the date of the enactment of this subsection.
  47.    
  48.    
  49.    
  50.    "(3) Paragraph (1) shall not apply to-
  51.    
  52.    
  53.    
  54.    "(A) any of the firearms, or replicas or duplicates of the firearms,
  55.    specified in Appendix A to this section, as such firearms were
  56.    manufactured on October 1, 1993;
  57.    
  58.    
  59.    
  60.    "(B) any firearm that-
  61.    
  62.    
  63.    
  64.    "(i) is manually operated by bolt, pump, lever, or slide action;
  65.    
  66.    
  67.    
  68.    "(ii) has been rendered permanently inoperable; or
  69.    
  70.    
  71.    
  72.    "(iii) is an antique firearm;
  73.    
  74.    
  75.    
  76.    "(C) any semiautomatic rifle that cannot accept a detachable magazine
  77.    that holds more than 5 rounds of ammunition; or
  78.    
  79.    
  80.    
  81.    "(D) any semiautomatic shotgun that cannot hold more than 5 rounds of
  82.    ammunition in a fixed or detachable magazine.
  83.    
  84.    
  85.    
  86.    The fact that a firearm is not listed in Appendix A shall not be
  87.    construed to mean that paragraph (1) applies to such firearm. No
  88.    firearm exempted by this subsection may be deleted from Appendix A so
  89.    long as this subsection is in effect.
  90.    
  91.    
  92.    
  93.    "(4) Paragraph (1) shall not apply to-
  94.    
  95.    
  96.    
  97.    "(A) the manufacture for, transfer to, or possession by the United
  98.    States or a department or agency of the United States or a State or a
  99.    department, agency, or political subdivision of a State, or a transfer
  100.    to or possession by a law enforcement officer employed by such an
  101.    entity for purposes of law enforcement (whether on or off duty);
  102.    
  103.    
  104.    
  105.    "(B) the transfer to a licensee under title I of the Atomic Energy Act
  106.    of 1954 for purposes of establishing and maintaining an on-site
  107.    physical protection system and security organization required by
  108.    Federal law, or possession by an employee or contractor of such
  109.    licensee on-site for such purposes or off-site for purposes of
  110.    licensee-authorized training or transportation of nuclear materials;
  111.    
  112.    
  113.    
  114.    "(C) the possession, by an individual who is retired from service with
  115.    a law enforcement agency and is not otherwise prohibited from
  116.    receiving a firearm, of a semiautomatic assault weapon transferred to
  117.    the individual by the agency upon such retirement; or "(D) the
  118.    manufacture, transfer, or possession of a semiautomatic assault weapon
  119.    by a licensed manufacturer or licensed importer for the purposes of
  120.    testing or experimentation authorized by the Secretary.".

  124.    (b) Definition of Semiautomatic Assault Weapon .-Section 921(a) of
  125.    title 18, United States Code, is amended by adding at the end the
  126.    following new paragraph:
  127.    
  128.    
  129.    
  130.    "(30) The term 'semiautomatic assault weapon' means-
  131.    
  132.    
  133.    
  134.    "(A) any of the firearms, or copies or duplicates of the firearms in
  135.    any caliber, known as-
  136.    
  137.    
  138.    
  139.    "(i) Norinco, Mitchell, and Poly Technologies Avtomat Kalashnikovs
  140.    (all models);
  141.    
  142.    
  143.    
  144.    "(ii) Action Arms Israeli Military Industries UZI and Galil;
  145.    
  146.    
  147.    
  148.    "(iii) Beretta Ar70 (SC-70);
  149.    
  150.    
  151.    
  152.    "(iv) Colt AR-15;
  153.    
  154.    
  155.    
  156.    "(v) Fabrique National FN/FAL, FN/LAR, and FNC;
  157.    
  158.    
  159.    
  160.    "(vi) SWD M-10, M-11, M-11/9, and M-12;
  161.    
  162.    
  163.    
  164.    "(vii) Steyr AUG;
  165.    
  166.    
  167.    
  168.    "(viii) INTRATEC TEC-9, TEC-DC9 and TEC-22; and
  169.    
  170.    
  171.    
  172.    "(ix) revolving cylinder shotguns, such as (or similar to) the Street
  173.    Sweeper and Striker 12;
  174.    
  175.    
  176.    
  177.    "(B) a semiautomatic rifle that has an ability to accept a detachable
  178.    magazine and has at least 2 of-
  179.    
  180.    
  181.    
  182.    "(i) a folding or telescoping stock;
  183.    
  184.    
  185.    
  186.    "(ii) a pistol grip that protrudes conspicuously beneath the action of
  187.    the weapon;
  188.    
  189.    
  190.    
  191.    "(iii) a bayonet mount;
  192.    
  193.    
  194.    
  195.    "(iv) a flash suppressor or threaded barrel designed to accommodate a
  196.    flash suppressor; and
  197.    
  198.    
  199.    
  200.    "(v) a grenade launcher;
  201.    
  202.    
  203.    
  204.    "(C) a semiautomatic pistol that has an ability to accept a detachable
  205.    magazine and has at least 2 of-
  206.    
  207.    
  208.    
  209.    "(i) an ammunition magazine that attaches to the pistol outside of the
  210.    pistol grip;
  211.    
  212.    
  213.    
  214.    "(ii) a threaded barrel capable of accepting a barrel extender, flash
  215.    suppressor, forward handgrip, or silencer;
  216.    
  217.    
  218.    
  219.    "(iii) a shroud that is attached to, or partially or completely
  220.    encircles, the barrel and that permits the shooter to hold the firearm
  221.    with the nontrigger hand without being burned;
  222.    
  223.    
  224.    
  225.    "(iv) a manufactured weight of 50 ounces or more when the pistol is
  226.    unloaded; and
  227.    
  228.    
  229.    
  230.    "(v) a semiautomatic version of an automatic firearm; and
  231.    
  232.    
  233.    
  234.    "(D) a semiautomatic shotgun that has at least 2 of-
  235.    
  236.    
  237.    
  238.    "(i) a folding or telescoping stock;
  239.    
  240.    
  241.    
  242.    "(ii) a pistol grip that protrudes conspicuously beneath the action of
  243.    the weapon;
  244.    
  245.    
  246.    
  247.    "(iii) a fixed magazine capacity in excess of 5 rounds; and
  248.    
  249.    
  250.    
  251.    "(iv) an ability to accept a detachable magazine.".
  252.    
  253.    
  254.    
  255.    (c) Penalties .-
  256.    
  257.    
  258.    
  259.    (1) Violation of section 922( v ) .-Section 924(a)(1)(B) of such title
  260.    is amended by striking "or (q) of section 922" and inserting "(r), or
  261.    (v) of section 922".
  262.    
  263.    
  264.    
  265.    (2) Use or possession during crime of violence or drug trafficking
  266.    crime .-Section 924(c)(1) of such title is amended in the first
  267.    sentence by inserting ", or semiautomatic assault weapon," after
  268.    "short-barreled shotgun,".
  269.    
  270.    
  271.    
  272.    (d) Identification Markings for Semiautomatic Assault Weapons
  273.    .-Section 923(i) of such title is amended by adding at the end the
  274.    following: "The serial number of any semiautomatic assault weapon
  275.    manufactured after the date of the enactment of this sentence shall
  276.    clearly show the date on which the weapon was manufactured.".
  277.    
  278.    
  279.    
  280.    SEC. 110103. BAN OF LARGE CAPACITY AMMUNITION FEEDING DEVICES.
  281.    
  282.    
  283.    
  284.    (a) Prohibition .-Section 922 of title 18, United States Code, as
  285.    amended by section 110102(a), is amended by adding at the end the
  286.    following new subsection:
  287.    
  288.    
  289.    
  290.    "(w)(1) Except as provided in paragraph (2), it shall be unlawful for
  291.    a person to transfer or possess a large capacity ammunition feeding
  292.    device.
  293.    
  294.    
  295.    
  296.    "(2) Paragraph (1) shall not apply to the possession or transfer of
  297.    any large capacity ammunition feeding device otherwise lawfully
  298.    possessed on or before the date of the enactment of this subsection.
  299.    
  300.    
  301.    
  302.    "(3) This subsection shall not apply to-
  303.    
  304.    
  305.    
  306.    "(A) the manufacture for, transfer to, or possession by the United
  307.    States or a department or agency of the United States or a State or a
  308.    department, agency, or political subdivision of a State, or a transfer
  309.    to or possession by a law enforcement officer employed by such an
  310.    entity for purposes of law enforcement (whether on or off duty);
  311.    
  312.    
  313.    
  314.    "(B) the transfer to a licensee under title I of the [*H8827] Atomic
  315.    Energy Act of 1954 for purposes of establishing and maintaining an
  316.    on-site physical protection system and security organization required
  317.    by Federal law, or possession by an employee or contractor of such
  318.    licensee on-site for such purposes or off-site for purposes of
  319.    licensee-authorized training or transportation of nuclear materials;
  320.    
  321.    
  322.    
  323.    "(C) the possession, by an individual who is retired from service with
  324.    a law enforcement agency and is not otherwise prohibited from
  325.    receiving ammunition, of a large capacity ammunition feeding device
  326.    transferred to the individual by the agency upon such retirement; or
  327.    
  328.    
  329.    
  330.    "(D) the manufacture, transfer, or possession of any large capacity
  331.    ammunition feeding device by a licensed manufacturer or licensed
  332.    importer for the purposes of testing or experimentation authorized by
  333.    the Secretary.
  334.    
  335.    
  336.    
  337.    "(4) If a person charged with violating paragraph (1) asserts that
  338.    paragraph (1) does not apply to such person because of paragraph (2)
  339.    or (3), the Government shall have the burden of proof to show that
  340.    such paragraph (1) applies to such person. The lack of a serial number
  341.    as described in section 923(i) of title 18, United States Code, shall
  342.    be a presumption that the large capacity ammunition feeding device is
  343.    not subject to the prohibition of possession in paragraph (1).".

  346.    
  347.    (b) Definition of Large Capacity Ammunition Feeding Device .-Section
  348.    921(a) of title 18, United States Code, as amended by section
  349.    110102(b), is amended by adding at the end the following new
  350.    paragraph:
  351.    
  352.    
  353.    
  354.    "(31) The term 'large capacity ammunition feeding device'-
  355.    
  356.    
  357.    
  358.    "(A) means a magazine, belt, drum, feed strip, or similar device
  359.    manufactured after the date of enactment of the Violent Crime Control
  360.    and Law Enforcement Act of 1994 that has a capacity of, or that can be
  361.    readily restored or converted to accept, more than 10 rounds of
  362.    ammunition; but
  363.    
  364.    
  365.    
  366.    "(B) does not include an attached tubular device designed to accept,
  367.    and capable of operating only with, .22 caliber rimfire ammunition.".
  368.    
  369.    
  370.    
  371.    (c) Penalty .-Section 924(a)(1)(B) of title 18, United States Code, as
  372.    amended by section 110102(c)(1), is amended by striking "or (v)" and
  373.    inserting "(v), or (w)".
  374.    
  375.    
  376.    
  377.    (d) Identification Markings for Large Capacity Ammunition Feeding
  378.    Devices .-Section 923(i) of title 18, United States Code, as amended
  379.    by section 110102(d) of this Act, is amended by adding at the end the
  380.    following: "A large capacity ammunition feeding device manufactured
  381.    after the date of the enactment of this sentence shall be identified
  382.    by a serial number that clearly shows that the device was manufactured
  383.    or imported after the effective date of this subsection, and such
  384.    other identification as the Secretary may by regulation prescribe.".
  385.    
  386.    
  387.    
  388.    SEC. 110104. STUDY BY ATTORNEY GENERAL.
  389.    
  390.    
  391.    
  392.    (a) Study .-The Attorney General shall investigate and study the
  393.    effect of this subtitle and the amendments made by this subtitle, and
  394.    in particular shall determine their impact, if any, on violent and
  395.    drug trafficking crime. The study shall be conducted over a period of
  396.    18 months, commencing 12 months after the date of enactment of this
  397.    Act.
  398.    
  399.    
  400.    
  401.    (b) Report .-Not later than 30 months after the date of enactment of
  402.    this Act, the Attorney General shall prepare and submit to the
  403.    Congress a report setting forth in detail the findings and
  404.    determinations made in the study under subsection (a).
  405.    
  406.    
  407.    
  408.    SEC. 110105. EFFECTIVE DATE.
  409.    
  410.    
  411.    
  412.    This subtitle and the amendments made by this subtitle-
  413.    
  414.    
  415.    
  416.    (1) shall take effect on the date of the enactment of this Act; and
  417.    
  418.    
  419.    
  420.    (2) are repealed effective as of the date that is 10 years after that
  421.    date.
  422.    
  423.
